What Incorporated Company Drivers Need To Know for Tax Season in Canada

A recent trend that has seen some company drivers incorporate themselves has stirred controversy in the trucking industry.

The article, linked below, from the Canadian Trucking Alliance clearly outlines the tax implications for those drivers. The CRA’s response to the Drivers Inc. movement is to classify them as PSB’s (Personal Service Businesses) and as such are ineligible for any small business deductions.

“Saskatchewan Implements MELT; Still No Decision in Manitoba
It was recently announced the the Province of Saskatchewan will be implementing Mandatory Entry Level Training (MELT) for commercial truck drivers, beginning in spring 2019.
The Manitoba Trucking Association has been in touch with Premier Brian Pallister about any steps being taken in Manitoba towards such a program; we did not receive an answer from the Premier’s office but our concerns were forwarded to the Minister of Infrastructure Ron Schuler MLA. We continue to wait for a response at this time.”

CN expands its North American intermodal supply chain services with the acquisition of TransX

MONTREAL and WINNIPEG, Oct. 30, 2018 (GLOBE NEWSWIRE) — CN (TSX: CNR) (NYSE: CNI) today announced it has reached an agreement to acquire Winnipeg-based The TransX Group of Companies, one of Canada’s largest and oldest transportation companies.

“This strategic acquisition allows CN to deepen its supply chain focus, strengthening our exceptional franchise, including our intermodal business, notably the specialized, fast-growing refrigerated segment,” said JJ Ruest, president and chief executive officer of CN. “TransX has a 55-year history of providing innovative customer solutions in an industry that continues to evolve.

“This alignment creates a solid framework to serve a growing consumer economy with transportation options that bring more supply chain flexibility to our customers,” Ruest concluded.

Mike Jones, chief operating officer of The TransX Group of Companies, added, “CN’s acquisition solidifies our future as an industry-leading intermodal services provider in North America. We look forward to working with the CN team, which will allow us to continue building long-term customer confidence.”

TransX will continue to be based in Winnipeg and will operate independently.

The terms of the deal were not disclosed and the acquisition is subject to regulatory review by Competition Bureau Canada and Canada’s Ministry of Transportation.

CRA & ESDC Clarify Status of Driver Inc & Enforcement to Trucking Industry

The Canada Revenue Agency (CRA) and Employment and Social Development Canada (ESDC) have clarified how they will treat the practice of so-called Driver Inc. by removing any grey area as it relates to the tax and labour status of incorporated drivers operating company vehicles.

The Driver Inc. model is based on commercial vehicle drivers, who do not own/lease or operate their own vehicle, becoming incorporated and receiving payment from their carrier with no source deductions. This practice opens the door to the possibility of widespread tax manipulation by those engaged in Driver Inc.

TransX to Participate in MPNP Information and Employer Engagement Sessions in Berlin, Germany (May 7-11, 2018)

Truck Driver Training Funding through the Province of Manitoba

We are now almost a month into the new year and are approaching this fresh start with renewed energy! 2017 was a tremendously busy year not just for us, but for our industry as a whole.

In Manitoba, the trucking industry took some significant leaps forward, thanks in part to our friends at the Manitoba Trucking Association (MTA). An industry sector council was finally developed to represent our interests as an industry as well as give us a platform to discuss the challenges and concerns moving forward.

One of the biggest challenges facing our industry now is the shortage of qualified drivers. Over the past 10 years, MPI’s Entry Level Professional Truck Driver Program was instrumental in providing this industry with well-trained and professional drivers. This ground-breaking program will be coming to an end soon after funding 562 drivers with 100% tuition.

mb-logoFortunately, the Province of Manitoba will be continuing this funding with a new policy for subsidizing truck driver training. As of January 1st of this year, full tuition funding will be made available to Manitobans interested in training to become a professional truck driver!

TransX is in support of this initiative and plan on participating later this Spring once it rolls out. Stay tuned for more details.
